President Barack Obama resorted to tired rhetoric and outright lies today, and resorted to using schoolchildren as props for his assault on the Constitution, but at the end of the day, his list of 23 executive orders amounted to little:

1. “Issue a presidential memorandum to require federal agencies to make relevant data available to the federal background check system.”

2. “Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system.”

3. “Improve incentives for states to share information with the background check system.”

4. “Direct the attorney general to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.”

5. “Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.”

6. “Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.

7. “Launch a national safe and responsible gun ownership campaign.”

8. “Review safety standards for gun locks and gun safes (Consumer Product Safety Commission).”

9. “Issue a presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations.”

10. “Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.”

11. “Nominate an ATF director.”

12. “Provide law enforcement, first responders, and school officials with proper training for active shooter situations.”

13. “Maximize enforcement efforts to prevent gun violence and prosecute gun crime.”

14. “Issue a presidential memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.”

15. “Direct the attorney general to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies.”

16. “Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.”

17. “Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities.”

18. “Provide incentives for schools to hire school resource officers.”

19. “Develop model emergency response plans for schools, houses of worship and institutions of higher education.”

20. “Release a letter to state health officials clarifying the scope of mental health services that Medicaid plans must cover.”

21. “Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges.”

22. “Commit to finalizing mental health parity regulations.”

23. “Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health.”

While Obama called for a ban on assault rifles (which haven’t been available for sale to the public in 27 years, since the so-called Firearm Owner’s Protection Act was signed into law in 1986) and standard capacity magazines of more than ten rounds, he belatedly seemed to acknowledge that he does not remotely have the authority to make such sweeping changes.

The assault on basic natural rights and Constitutionally-protected liberties from this President and his allies will not relent, but his actions today, if limited to the articles above, amount to little more than words.

Obama blinked, and in so doing, may have averted—for a time—a second American Revolution.

We have neither “won” nor “protected” anything today, except more time to train and prepare for a more brutal conflict, and rest assured, that is precisely what Obama intends to bring against America. He needs breathing space to arm and attempt to consolidate his allies behind him, and has four years in front of him.

Arm. Train. Network. Resist.

Tread carefully.

      Guess it depends how you look at it, as far as Cuomo goes. I’m betting Cuomo’s camp is thinking it makes him look even stronger, passing laws in NY that the current President is afraid to/cant/etc.
      Cuomo will be bragging about this for the 2016 elections, for sure. Along with how many lives it “saved” (complete with no data to back it up).

      Me… I just see unconstitutional “laws” being bullied into existence by someone who cares only about his political career and making a name for himself.

      The claim there is that the great WonderBarry really intended to go all-in with confiscations & the whole 9 yards. Rather like news reports from yesterday were saying. The annonymous “republican insider” seems to think the NRA forced him to back down. I’m sure they did come out swinging but think there’s more to it.

      I think Mr. Owens hit the nail on the head when he said a great number of ordinary Americans are preparing for war. How many? Who can say? Go to Cabela’s Cheaper ThanDirt or Georgia-Arms & see if you can get ammunition or ammo magazines that work in your gun. The current state of supply/demand is very alarming! It must be enough to make an ego-maniacal communist jihadi wet his bed.

      Anyhow review recent history. WonderBarry has gone to great expense (your expense) to arm our enemies both foreign & domestic. The only people he’d like to disarm are peaceful patriotic Americans.

    Agreed. I watched it live this morning. I referred to it as;

    “That Guy just squatted down and made grunting noises but instead of squeezing out a steaming pile he just produced an odorous cloud.”

    I’m guessing someone in the House or Senate explained reality to him. I don’t see any meaningful gun control legislation in the immediate future. The problem for the anti gun left is that the president gave elected democrats (and republicans for that matter) an opening to cave on this issue and they’re going to be under a lot of pressure from their constituents to do precisely that.

      Remember, the Congressional Rs held their tongue on this during the last month precisely so the Left could hang themselves in the ’14 election with all the outrageous statements they could make before anything official was released. As explained to me by a politico I know, “Why say anything when the other side is hanging themselves?”

      I agree, the lawyers at ATF and Justice explained that Obama cannot go beyond what Congress has passed, and we all know the parameters that exist in current law.

      As for the EOs, we’ve all seen this stuff before, especially #15, which is the tired old “smart gun” argument we’ve fought against for years. Even cops don’t want them.

      Commander Zero blinked. Plus, I think Uncle Joe probably got taken to the woodshed for shooting his mouth off last week about “executive orders” and not knowing a damn thing about what he was talking about. What an idiot. That’s how the Berlin Wall fell, by a minor official misstating what was going to happen.

    EO #4 could be trouble. AG Holder will categorize us & determine which groups are “dangerous”. Hmmmmm….I wonder where Right Wing Extremists, Hobbits, or Ex-Military will fall?

    Also, B.O. acknowledged Congress’ authority over the illegal immigration issue; but then, when they didn’t do what he wanted, we go amnesty by Executive Order.

      This is the innocuous E.O. that will take away the “….right of the people to keep and bear arms shsll not be infringed.” thus, effectively trashing the 2nd Amendment in the Bill of Rights.

    I’m frankly amazed. He wrote this down? This reads like a list of existing executive failures.

    I assumed all these things were all ready in place and working. #5 seems the most locally ripe for abuse, but we don’t already have a defined list of “categories of individuals prohibited from having a gun” (item 2)? Does he not know about the CMP (item 7)? Seriously? These are the monkeys we’ve given the responsibility for our nation?

    It now knows the names of many of its enemies.

    All the people who spoke up, on the internet, or in the press.

    All the people who recently purchased weapons, ammunition and so forth.

    All the people with the cogent arguments.

    And, with the NDAA, there is the mechanism to “disappear” people.

    Agree that it is ripe for abuse.
    My concern is what is the “other hand” doing? I just can’t see someone with the psychological makeup of obama putting something like this out there. I don’t believe that anything will get through the House; or will their arms be twisted by the debt ceiling? Still think not.
    Is he counting on nothing being done and utilizing the UN Small Arms Treaty to get this agenda through?
    Or -tin foil hat time- is he hoping that a govt. shutdown will trigger riots that will require martial law and a suspension of the Constitution?

    Dear Bob,
    Thank you for your article. For me, while I breathed a sigh of relief immediately following the President’s presentation, I have this sense that we will be here again. When and how I do not know. In the meantime, however, we must all agree that there is a major fight laying ahead of us in Congress. We still have Feinstein, Cumo, Bloomberg and Soros to deal with. Some states will fall.

    Let this serve as a wakeup call for all us. We must take this respite as an opportunity to organize, network, plan, prepare and press back on existing gun laws. Please realize that it will only take one more event in a ‘gun free zone’ for us to be at this place again. We must increase our ranks: one thing that was evident was that Obama knows he must increase the numbers of the mob who will put their full faith in the US Government. We must also increase our ranks. Let each of us try to recruit new shooters and NRA/GOA members from our friends and family.

    Also, we cannot forget New York. Hunting season will never be the same in New York and Citizens will die in even greater numbers in New York. What is to say something similar is not being plotted in your state this very evening?

    Well some of the orders either attempt to rewrite law or sidestep congress on appointments. That in itself is horrendous. But we’re here to talk about guns. What these are is a refinement of future gun confiscation mechanism. They already control health care. They already have leftists planting articles in medical journals stating that conservatism is a mental disease. Pretty soon the Feds will be able to deem individuals unfit for gun ownership. Were you a rambunctious boy that the school labeled ADD to get more government cash. No gun for you. Postpartum depression? No gun for you. Elderly? No gun for you. Veteran? Probably have PTSD so no gun for you. This country used to forcibly sterilize people because they were deemed unfit for society. No they will use the same arguments early progressives (and Nazis) used to grab our guns. No the executive orders didn’t order immediate confiscation and trigger a war. We have time. But the orders are still troubling. Because they do end in confiscation. And they plan on taking the slow stealthy approach to lower resistance. They will Overton window us into disarmament and subjugation.

    The next time these animals have control of both houses of congress and the Presidency, the Feds will try again. And again. And again. That is the nature of Socialism – attempt after attempt, moving the bar, erosion. Our Constitution was designed to stand up to this process – but they found the fatal flaw in the Elastic Clause and Constitutionalism has been dead in this country ever since.

    We all have been given a Federal reprieve for a few years … hopefully this scare, and the events in NY, have shook awake more of our fellow Americans.

    But, have no doubt – eventually the 2nd amendment will be scrapped. The 1st amendment will be modified in order to limit “hate speech” (ie – anti-government speech). National healthcare. Soaring tax rates. Continued erosion of property rights and values. 20%+ unemployment. This country will be a bigger, nastier, more violent European Union in ~10-12 years.

    Plan now. Stash now. Train now.

      #2 – Mr. Owens told us the vast unknown little people of America are preparing for war. My slight research appears to confirm it. IF it were not so perhaps all would be lost. IF it is so perhaps tyrants will lose courage.

    Thinking about this further, we really made our Imperial leader blink hard.

    Think about it: In the list of EOs, there are no physical restrictions at all on imported magazine bans, or ammo import bans. He theoretically has the power to do that, and he did not. (At least not yet; there could be ATF rulemakings ahead that he did not announce to catch us off guard.)

    I was surprised when there was nothing about limiting importation of existing surplus 10+ round magazines, or ammunition from foreign sources such as Wolf. You’d think there would have been something about “military caliber” ammunition restrictions, but nothing at all.

    I’m surmising what made him stop and think was simply the actions of millions of Americans over the last two months to not only buy as many firearms as could equip both the Chinese and Indian armies, but exhaust the entire supply of ammunition in the United States. That’s never happened before. It didn’t happen in 1968, or 1994.

    Instead of vilifying firearms ownership and the NRA, the American people not only embraced both–they were using their pocketbooks to actively defend their 2A rights.

    That’s pretty incredible.

Outside of three or four of my friends who feel as i do, how do I find people to network with who arent nut-jobs or setting me up for a midnight visit from the authorities investigating domestic terrorist plots? How can i find the good people with right intention that I can talk to face to face? I really do want to know…

      Slightly off-topic, but we need to prepare for when we all have Undercover in L.A.’s problem. We have the luxury the internet and bob-owens.com to hash these things out on now, but it would be foolish to not plan ahead.

      Bob, we need to prepare communications channels that anybody can use that do not depend on the Internet of the feds.

      What those are or how they might be constructed, I have no clue, but I am sure there are people who do and we need to implement that as well. Also, we need to practice it with dry runs simulating the loss of the internet.

    One thing to avoid about all of this analysis is not to pull a typical Capitol Hill move and only read the executive summary. The WH counted on us being lazy, and being from that political world I am afraid I fell into that trap when first reading about this stuff this afternoon.

    Another gun blog recommended I actually read the WH’s proposal, and in doing so found this little turd about C&Rs. It’s only a recommendation to Congress, NOT an EO, but still, someone at somewhere knows their stuff about our little arcane world. This is an obscure move, and only shows the extent of how far they want to go.

    Eliminate restrictions that force the ATF to authorize importation of dangerous weapons simply because of their age: ATF is required to authorize the importation of certain “curio or relic” firearms, and outdated regulations include all firearms manufactured more than 50 years ago in the definition of “curio or relic.” But today, firearms manufactured more than 50 years ago include large numbers of semiautomatic military-surplus rifles, some of which are easily convertible into machine guns or otherwise appealing for use in crime. Congress should get rid of restrictions that prevent ATF from changing this definition, enabling ATF to ensure that firearms imported as curios or relics are actually of interest as collectibles, rather than letting these rules be used as a way to acquire fully functional and powerful military weapons.

    If the authorities take possession of a weapon, they can check medical records to discover reasons to never return it.

    6. Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.

    - What this means:
    "Encourage" the sporting goods chains and big-box stores to consult these newly collected records for reasons to deny a sale. Expect "Guidance" to become

    "Require" shortly after the next shooting.

    7. Launch a national safe and responsible gun ownership campaign.

    - What this means:
    Your tax dollars will be used to manufacture a publicly funded Anti-NRA.

    8. Review safety standards for gun locks and gun safes (Consumer Product Safety Commission).

    - What this means:
    Lean on producers of gun locks and gun safes. This will make them more expensive. Recall that many states have regulations w/regards to weapon storage. The idea is to increase the up-front expense of owning a firearm.

    9. Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations.

    - What this means:
    The various federal agencies will use this as an excuse to pilfer the records of FFL license holders when a weapon they sold is used in a crime. De-facto registration.

    10. Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.

    - What this means:
    You lost your AR-15 in a tragic boating accident and reported it stolen? Now they can easily check if you are in violating USC, Title 18, Section 1001.

    11. Nominate an ATF director.

    - What this means:
    I’m positive Obama will select a true champion of gun rights.

    12. Provide law enforcement, first responders, and school officials with proper training for active shooter situations.

    - What this means:
    Unless they are going to arm groups 2-3, don’t expect much here beyond suspensions for playing cowboys and Indians. It’s not in their interest to meaningfully stop gun-violence.

    13. Maximize enforcement efforts to prevent gun violence and prosecute gun crime.

    - What this means:
    Expect every trivial violation of federal gun law to be pursued with all the forgivness, mercy, compassion, and tenderness of a bull shark.

    14. Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.

    - What this means:
    Concoct a list of every possible medical condition, drug, or mental health issue that can be used as rational to deny sale of /seize weapons.

    15. Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies.

    - What this means:
    Pressure to coerce firearm manufacturers into neutering products. May be a framework for mandatory regulations down the road. Might also be a womb for litigation should the companies ignore these "suggestions."

    16. Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.

    - What this means:
    Re-writing the Affordable Care Act to remove language inserted by Harry Reid w/regards to health records. This should not be possible through executive order. Unless congress will impeach, and senate will convict, will happen regardless.

    17. Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities.

    - What this means:
    Informing doctors they have permission to ignore the law. Should make for plenty of fun litigation down the road. Any Dr. taking this advice had better have insurance up to date and attorney on speed-dial.

    18. Provide incentives for schools to hire school resource officers.

    - What this means:
    Unless these "officers" are armed, consider them nothing more than feel-good C.Y.A anti-gun propagandists. As well as mandatory reporters if they can coax a child into talking about parental firearms.

    19. Develop model emergency response plans for schools, houses of worship and institutions of higher education.

    - What this means:
    C.Y.A. Dog squat. Will provide a nice excuse to militarize the various federal agencies though. Expect more RFP’s for Dept. Edu Remington 870′s.

    20. Release a letter to state health officials clarifying the scope of mental health services that Medicaid plans must cover.

    - What this means:
    Expand medical coverage to a positively dazzling number of mental health ailments. Which will be recorded, and used as a reason to deny/seize firearms.

    21. Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges.

    - What this means:
    Provides a pretext to implement 1, 2, 3, 16, 17, 20, 23. Legality questionable. Will be challenged the second someone has proper standing. In several years.

    - What this means:
    See 21.

    23. Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health.

    - What this means:
    Demonize and propagandize a wide swath of mental issues, illnesses, and medications to squelch the outcry when they start disarming people.

    I think it’s possible that one of the reasons the administration did this whole thing, with threats of Exec Order, and so on, was to find out how people would react. I also think they have been completely bowled over by the reaction from all across the country. They have obviously retreated.

    But… now they know who the rabble rousers are, the ways that people are likely to react, and now they will plan a new course of action. I think we can expect more horrible events like Newtown.

    I also think the Elites are scared. The one thing they do not wish to do is to awaken the sleeping giant. They now know that they have to tread lightly, or with stealth, as the giant is sitting up and shaking the sleep from his eyes. Once the giant is fully awake there will be no where for them to hide.
