Prelude to a revolution: Shumer’s gun transfer ban

Chuck Schumer’s S. 374, the Orwellian “Protecting Responsible Gun Sellers Act of 2013,” has been an empty shell… until he slipped in Amendment ALB13180 (PDF) today, which shows the “teeth” of the bill.  It is an extremely aggressive attempt to destroy the Second Amendment by isolating and criminalizing extremely common behaviors among gun owners.

Doubt me?

Take a looking at a sampling of what it Sebastian notes it would outlaw:

  • If you leave home for more than 7 days and leave anyone at home, that becomes a felony illegal transfer. 5 years in prison for each of you.
  • if you take a friend shooting and allow him to fire your gun, that is a felony illegal transfer. 5 years in prison for each of you.
  • If you have a gun lost or stolen and don’t report it within 24 hours, you’ve committed a felony. 5 years in prison.
  • If you lend a gun to someone for to try out at the range, provide a loaner for a student in training, let your son shoot a rifle you purchased while hunting, or provide a gun to a woman for self-defense, you’ve committed a felony. 5 years in prison for each of you.

That’s just scratching the surface. Make sure you read the rest about how it could Schumer’s law put gun dealers out of business, and create a de facto national registry… a prelude to confiscation.

It’s inching closer.

    If it were, we’d have a Constitution, and it would not have been sh*t upon and eliminated.

        I believe they know full well the “sh*t storm” they are creating. I’ve believed for a long time they are intentionally trying to get us to revolt, so they can clamp down on us even more… Martial Law would give them the “right” to tell us what we can and cannot do from morning until night.

    IMO this will never get out of the senate and go to the house. Even if it made it to the house it would be defeated. Its show boating. Its a valuable propaganda gift because it blatantly shows their true intentions. The likes of Cruz and Rand Paul will know how to use it. The only way for the fascist left to advance their ‘gun control’ agenda is via executive orders. IMO the battle is in the states.

      It actually doesnt need to get out of the Senate. What no one seems to have noticed is that this week FINAL treaty negotiations are being signed at the UN to ban small arms. As a signatory to the UN, this deal is all that is needed to justify the full clampdown and disarmament of Americans, and nary a word of it amongst the ‘patriots’ out there. Pathetic.

    I no longer even recognize the “authority” of our elected buffoons to make laws that affect me. They’ve proven to be beneath my contempt by virtue of their own actions. They care nothing for the rights of free Americans and this disdain manifests in “laws” designed to punish ALL citizens for the transgressions of the individual.
    Here’s a thought, We the People are NOT kindergartners, you will NOT be treating us as such. Keep pushing and we’ll soon see whose will is greater.

    They want to criminalize as much of our mundane life as possible not to come lock us all up but so we will shut up and be ruled quietly because anyone who speaks out or confronts them can easily be arrested for something. For instance a known enemy of the political elite can’t be co-opted wait till he goes on a business trip leaving his wife home with the children and guns then arrest them both and take away the children. Opposition neutralized and the state run media will help destroy them for good measure.

    Good to know that if my elderly Mother grabs a gun to protect herself from an intruder we can both be charged with a felony. At some point you just want the war to come so we can restore some measure of sanity.

    Like the Colorado bans, this is entirely unenforcible.

    Here is my thought: just as the right to vote cannot be encumbered by poll taxes, so too, it is an infringement on the right to bear arms for there to be any impediments put in the way. This was one of the points of Heller, and I expect that in the unlikely (but unfortunately not impossible) event that this thing passes, it would be struck down as well.

    Although I admit my faith in the courts is severely lacking these days . . .

    But if push comes to shove, we will not comply.

    One question: Do these asshats know how big flyover country is? It is almost as if they put this in there to make sure the thing fails.

        Bill; You are correct, IE “everyone is waiting for the big one”: Those in power who desire to control us know this, and do it to us in slw, small, steady increments; and we stand back being pushed a little furhter each time towards the end of the cliff. And I doubt, although I hope I’m wrong, will never fight back; REALLY fight back.

    Correct me if I am wrong, but 202(4)(2)says that 202(4)(1) does not apply to gifting betwen spouses, siblings or grandparents to grandchildren; Passing down as a result of death. Temp transfer under 202 (2)(C) says temp transfer is allowed even for hunting so long as the person legally engages in said activity blah blah. Now if you loan it to them it is legal so long as it is less than one week and also assuming that they possess the proper paperwork to hunt the king’s animals…leaving home and having a house sitter for 8 days is not a transfer of a firearm. Transfer of a firearm is the owner physically relinquishing control of the firearm to another person under the agreement that the other person is knowingly taking control of the firearm from the owner.

    Im the first person to get riled up and I know this will be a slippery slope. Im just saying that the actual code sections dont say all of what you are saying they do. You are correct about the lost/stolen (section 203) part…I guess no more boating accidents when the time comes.

      Lots of people I know are lawyers interpret it differently than you do.

      Transfer of a firearm is the owner physically relinquishing control of the firearm to another person under the agreement that the other person is knowingly taking control of the firearm from the owner.

      Leaving someone to watch your home includes all the property within it. That would mean a house-sitter has taken control of the firearm.

      Forgive me but all these laws are bs. No politician has the authority to violate the second ammendment. There should be a law that states that if a politician violates, or attempts to violate the constitution by act or deed or bill, they will be considered to have foresaken their oath and thus quit their job being outside the scope of theirbemployment. Further, an attempt via deed or bill or law requires the politician to forfeit his total property, holdings, and all assets prior to the bill being considered. Further, if any so acting politician crosses any state line, they shall be arrested and incarcerated for civil, constitutional, and human rights violations with a minimum mandatory sentence of 10 years per count.

        Oathkeepr; There IS such a law, at least as far as literally, instantly, removing them from office, and all without any court needing to act. Read the 14th Amendment, Bill of Rights, paragraph 3, then consider this. IF any legislator, or any other public officer acts in such a way that denies, sets-aside, or opposes the power(read authroity) of the Constitution, have they not committed an “insurrection” and/or “rebellion” against the Constitution? If you answer is yes, then they are immediately out of office.

    Letting a pro gun control ideologue draft firearms legislation is like letting NAMBLA craft legislation on kiddie porn.

    The most insidious part of almost all gun legislation is the presumption of mens rea. Put simply, is case a liberal is reading this, that means gun legislation is written with the presumption that even a technical violation is an act of criminal intent. The legislation crafted by Charles Schumer criminalizes innocent acts. Asking my buddy to put my shotgun in the car before we go on a hunting trip is felonious act under Schumer’s law.

    Under the new New York SAFE act, possession of a larger than 10 round magazine is a class D felony, worse that the penalty for criminally negligent homicide and sexual assault on a child and many other violent crimes.

    The whole idea is to produce a legal minefield so difficult to navigate lawfully that a large number of gun owners are converted into felons, disabled from owning guns under current federal legislation.

      Actually, the NY SAFE act makes possession of a “high capacity ammunition feeding device” a Class A Misdemeanor, not a felony.

Those folks that vote for them are their legal serfs. They remind me of the Italian Communist Party in the ’80s, when they were on the verge of being voted in to control of the Italian government.     There is also no exemption for transport or repair. Hand your gun to TSA agent at an airport for a flight – you are a felon. Pick-up your gun after a trigger job, you’ll need to file a 4473 to get it back.

    It is clear that everything the gun grabbers are doing is all about picking us off one at a time.

    Pass this bill or that, add a new law here or there, but what they all add up to is each one of these laws makes another of us a criminal, citizens who are law abiding otherwise.

    Then they wait for something to happen, say like your house is broken into and you defend it or someone you love is attacked and you come to their aid, etc, etc,, with all the new regulations they will have a good chance to charge you with something or other to brand you a criminal or take your arms away. The weak hearted will give in to keep the government at bay, give up their guns or even try to comply with the regulations.

    This has happened before! And there was always those that said; comply and no harm would come to you, move to the ghetto; at least we are still alive, get on the train because they really won’t do real evil, because they need us, because they are human too and they can’t be really that evil, they only want what is best!

    I SAY THEY ARE EVIL and there is only one thing that you can do with evil, FIGHT IT, in every inch, in every valley, on every hill, in every field; in every way you have; with every tool at your disposal, till either evil is defeated; is destroyed, and if it takes days, months, years or generations, YOU NEVER GIVE UP; EVER!

    Actually, I’ve come around to support this legislation whole heartedly, since most Democrat legislators surely own guns for self-defense or campaign props and they can’t take them to DC. This means they leave their guns at home with their families or house-sitters. 5-years in jail, vacate the Senate and House seats, and have a nice day.

    And Obama has released photos where he’s shooting a shotgun. Did he own it? If not, 5-years in jail. If he did, he probaby forgot to pack it to Hawaii on vacation. 5-years in jail. If his Secret Service left a personal or back-up gun at home on the Hawaii trips, jail them too, along with probably the bulk of federal law enforcement officers who have to go TDY on occasion.

    Chuck Schumer has given Republicans the mechanism to carry out the Great Government Purge, if only they’ll sign on and have the guts to arrest pretty much the entire other side of the aisle.
